🔴 UPDATE: March 10, 2025
Federal Judge Blocks Khalil’s Deportation, Sets Emergency Hearing for March 12
In a major legal rebuke to the Trump administration, a federal judge has ordered that Mahmoud Khalil cannot be removed from the United States pending a hearing on his case. The order—issued by Judge Jesse M. Furman of the Southern District of New York—cites the need to preserve the court’s jurisdiction over the case and sets an emergency hearing for March 12, 2025, at 11:30 a.m. in Manhattan.
Key Developments:
Deportation Temporarily Blocked: The judge ruled that Khalil must remain in the U.S. until the court decides whether his detention and potential removal are lawful.
Emergency Hearing Scheduled: The March 12 hearing at the Thurgood Marshall Courthouse will determine how the court will proceed. The government must respond by March 11 at 5:00 p.m. on whether the hearing is necessary or if a briefing schedule should be set.
Legal Justification: The court cited the All Writs Act (28 U.S.C. § 1651), emphasizing that courts have the power to block deportations to protect their jurisdiction when a case is under review.
🔍 Why This Matters:
A Significant Setback for Trump’s Crackdown: The ruling prevents ICE from deporting Khalil before due process is carried out, undercutting the administration’s attempt to target legal immigrants for their political views.
Judicial Oversight vs. Executive Overreach: The court’s decision reinforces the principle that even permanent residents accused of wrongdoing have the right to legal recourse before facing removal.
A Potential Legal Precedent: If the court ultimately rules in Khalil’s favor, it could set a major precedent for immigrant rights and protections for noncitizens facing politically motivated enforcement actions.
🚨 The Bottom Line:
The Trump administration’s attempt to remove a legal U.S. resident for protesting just hit a wall. With a federal judge stepping in to halt the deportation, this case will now play out in court rather than through unilateral government action. The Department of Government Extinction’s authoritarian ambitions are once again being checked—but the fight isn’t over.

Great news. But the courts will not stop him forever
As I understand it no charges were made at time of arrest. Is it a question of the court wanting to keep jurisdiction over j the legality of the ( clearly illegal) arrest itself? Or jurisdiction over the legality of deportation? Or are the 2 intertwined?
Could you please clarify this? I really appreciate your work.
